Institute red-faced as HC won’t ban IIT topper’s book

New delhi Faridabad boy Nitin Jain, who topped IIT-JEE exam in 2009 and also bagged the top position in the All India Engineering/Architecture Entrance Examination (AIEEE) that year, has won another bout. The Delhi High Court has dismissed a petition by FIITJEE, the coaching institute where he prepared for the exams, seeking an interim restraint order against publication and distribution of The Secret of My Success, a book penned by Nitin, who now studies at IIT-Delhi’s Computer department.

While the 252-page book, which hit the bookstores last month, elaborates the efforts made by 18-year-old Nitin along with his tributes to those who contributed to his success, the coaching institute was aggrieved that certain portions of the book were “defamatory, offensive and fallacious”. FIITJEE also moved the court seeking a permanent injunction against the publication of the book and also a declaration that the remarks against it were unjustified. It also sought a directive from the court to remove all such statements made by Nitin and his father N C Jain in the book.

But after a Single Judge refused to entertain the plea, FIITJEE challenged it before the Division Bench of Justices Vikramjit Sen and A K Pathak, which also refused to stay the publication or distribution of the book. “All these facts are within the personal knowledge of the author and his parents. In case the appellant disputes the same it has to prove to the contrary, for which it has to lead evidence discrediting the version of the author and his parents,” the Bench held. On Wednesday, the High Court will take up the main case regarding the permanent injunction.

In the book, Nitin has denied writing any ‘letter of appreciation’ crediting his triumph to FIITJEE and its faculty. While the letter was part of several of the institute’s advertisements and brochures after Nitin’s success, the book claimed he was “subtly pressurised” and “cajoled” into writing the letter and most of it was not true.

FIITJEE, however, claimed Nitin and his parents had given several interviews saying the institute’s role in his success was most important. FIITJEE also took offence to a statement by Nitin’s father that the institute made them make several rounds for disbursing the monetary award to the topper of their ‘Talent Reward Exam’. Moreover, the book says Nitin got just Rs 75,000 instead of the Rs 1 lakh declared.

N C Jain said the order has armed him with another reason to fight for the cause of students, who are looking to emulate his son. “The main case is listed for tomorrow and I am going to stick to all the statements made in the book, for they are absolutely true,” said Jain, adding that Nitin did not know about the legal issues as he was occupied with his second semester exam.

Despite repeated attempts, FIITJEE could not be contacted.

 

DEEP-CONSPIRACY AGAINST THE FAMILY OF NITIN JAIN, TOPPER OF IIT-JEE 2009, BY SOME COACHING INSTITUTES

Respected Hon. Sir/Madam,

My son Nitin Jain topped the Joint Entrance Exam for the IIT (IIT-JEE) and the All India Engineering Entrance Exam (AIEEE) in 2009, securing 1st Rank in both these competitive examinations at the All India level. Besides this he did India proud by winning three Gold medals in three International Science Olympiads held in Indonesia, Mexico and Iran during the years 2008-09.

Being a very intelligent, hardworking and sincere student Nitin has topped in almost all the classes from Ist standard to 12th class in his schools. For his spectacular success in IIT-JEE and AIEEE entrance examinations last year Nitin was honoured by top dignitaries of our country like the then Former President of India His Excellency Dr APJ Abdul Kalam, Honourable Prime Minister Dr. Manmohan Singh, Honourable Union Minister of HRD Shri Kapil Sibal, Honourable Chief Minister of Haryana Shri Bhupinder Singh Hooda etc to name a few. He was also honoured by the President of Republic of Iran, President of Indonesia, Lok Sabha speaker of Mexico and Nobel literature.

Unfortunately, while we were celebrating Nitin’s success, we were greatly surprised to see huge advertisements in various national newspapers
issued by a number of Coaching Institutes across the country displaying my son’s picture, indicating that he had taken coaching from such institutes. This was totally untrue and misleading, and aimed at cashing on Nitin’s name for their commercial interests. One of these institutes had, in fact, nothing to do with Nitin’s coaching, whatsoever. The other institute from where Nitin had taken coaching printed a hand written certificate from him, which he had been coerced into writing, without our knowledge. All this happened when Nitin was just a minor and didn’t have any knowledge about the frauds/criminals.

When the advertisement was printed in beginning, I told them not to print that anymore on phone as well as personally but they didn’t bother. There was no end to this campaign by the coaching shop owners, with full-page advertisements being issued by them, giving false claims of my son. This forced me to send even legal notices for stoppage of such misleading advertisements. However, still, we failed to control these coaching institutes who continued with their malicious campaign, damaging reputation of my son and the family, so much so that false rumors were circulated in my social circles that I had taken large sums of money from these coaching institutes for agreeing to these advertisements. To a middle class man, this has been a big blow.

Not only did the campaign continue unabated, we found one of the institute involved in a much bigger scam(cyber crime) — of creating websites in the name
of my son and doing business through such sites. www.iitjeetopper.com is one such example, which we suspect has been created maliciously by one such
coaching institute. At this site, there is a column named ‘ask me-detail’ and invite the citizens of the country to ask queries whereas answer those queries themselves in name of Nitin Jain. Also the site contains the photo of Nitin Jain. In the very same site, a blog is created in name of Nitin also. It seems that this site is owned by us but we are nowhere to be involved in this.

There have also been false news stories carried by some leading
newspapers from different corners of the country, planted by one of the
coaching institute. These stories made all sorts of false claims for having tutored Nitin in different Indian towns, when, in fact Nitin had never visited such places. This coaching institute has misused my son’s name for their commercial interests. This coaching shop owner has disturbed our life and put us to agony and mental torture by falsely using the name and fame of our son for its own ulterior purposes.

Whereas the real truth is as follows:-

My son, Nitin Jain, did two year classroom(weekend) program from one of the above mentioned institute at Kalu Sarai centre, South Delhi. While studying there when the classes were till late evening, Nitin sometimes used to come home with his chemistry teacher, as he also lives in Faridabad. Since Nitin came with him 10-12 times, our relations with the teacher grew closer when we came to know that he was from the same native place in state Rajasthan as we were and we trusted him. We had no idea that the person whom we greeted so warmly will play with our trust. We never had thought that the person whom we called our honourable guru/teacher would do such a work like a cheater. Now here are some of the things he has done with us-

1) 12 April 2009 – On the day exam of IIT-JEE 2009, the above mentioned teacher came in the evening at the exam centre, and took the Nitin's question paper with him assuring that he will return it the next day after getting the photo copy. But the papers have not been returned till now. Like very parent we also had a dream to see the paper of our child but we are not able to hold it once.

2) 23 May 2009 – Just two days before the day of declaration of IITJEE Result 2009, that teacher came to our house around 8 am with four other people who he said had come from Mumbai to make a video of ours. When I asked them about the video, they said that they will take an interview of ours in which we had to answer according to them. When I asked them how the video would be used, they assured me that they just wanted to show it among their enrolled students and it will not be leaked for external purposes. The video-making continued till 4 pm. Now that video has been put up at least 20 websites.. All this is spoiling our family’s image. Moreover they are sending emails all over India through Google Mail Alert to see those videos that are made on their commands so there is no guarantee of trueness and their own money is spent on its making and these videos do nothing except misguiding the people of the country and betraying the trust of students community.

On the same day that teacher got some papers signed by Nitin in which some were blank and on some papers there was something written. All this happened outside my home in his car. At that time Nitin was a minor and he was not aware of the fraud that they were doing. We came to know about this a very few days ago in the beginning of May 2010 by a neighbor who had seen him signing. Then we asked this about Nitin, then he agreed.

3) 25 May 2009 – On this day, IIT-JEE 2009 results were declared. That teacher came to our house just after results. By that time, media had also started coming. We were not aware of his interests. We let him and Nitin in front of the media. After staying at home for sometime, he told us that Nitin has to give some interviews to TV channels. That person made Nitin sit with him in
